The purpose of this resolution is to set the fees for the collection of services for the evaluation and monitoring of licences, permits, authorisations and other instruments of environmental control and management.
Services provided by the Environmental Licensing Authority (ANLA). The services provided by the National Environmental Licensing Authority (ANLA), correspond to the following procedures:
1. Evaluation. This is the documented and systematic process carried out by the National Environmental Licensing Authority (ANLA) to obtain, modify and integrate environmental licences, permits, authorisations and other environmental control and management instruments, in which it objectively determines whether an environmental study complies with the terms of reference, whether it provides sufficient information for decision-making, whether the environmental management proposals are in accordance with the principles of conservation and sustainable development and whether the proposed project is environmentally viable in terms of what is set out in the study.
2. Monitoring. This is the process carried out by the National Environmental Licensing Authority (ANLA) to verify compliance, progress and effectiveness of the environmental regulations in force and the obligations contained in environmental licences, permits, authorisations and other environmental control and management instruments in each of their phases or stages (construction, assembly, operation, maintenance, dismantling, final restoration, abandonment and/or termination), as the case may be.
The following activities, authorisations, environmental control and management instruments and others assigned by law and regulations are subject to charge in the framework of the evaluation process (obtaining, modification and integration), by the National Environmental Licensing Authority (ANLA).
1. Whether or not it is necessary to present an Environmental Diagnosis of Alternatives (NDAA).
2. Environmental Diagnosis of Alternatives (DAA).
3. Information Meetings and Public Hearings.
4. Ex officio public hearings on licensing projects that affect civil society reserves.
5. Environmental licensing and/or Environmental Management Plan and other instruments of environmental control and management, as well as those that are assumed from other authorities or entities and that are assigned by orders issued by judicial and/or control authorities, the law and/or regulations.
6. Environmental licenses under the jurisdiction of the National Environmental Licensing Authority (ANLA) that affect areas of the National Natural Parks of Colombia.
7. Environmental technical opinion.
8. Pronouncement on improvement activities (CTM).
9. Total or partial assignment of Environmental Licences, Environmental Management Plans and Environmental Technical Opinions.
10. Environmental recovery or restoration plan.
11. Selective Collection System and Environmental Waste Management.
12. Authorisation for the import and export of specimens of biological diversity NOT included in the appendices of the CITES Convention.
13. Permission for Suppliers of Marking Elements of the National Identification and Registration System for Wildlife Specimens in ‘Ex Situ’ Conditions.
14. Environmental permits, concessions and authorisations.
15. Authorisation for the Export of Hazardous Waste – Transboundary Movement.
16. Study permit for the collection of specimens of wild species of biological diversity for the elaboration of Environmental Studies (REA).
17. Single national laissez-passer for the movement of specimens of biological diversity.
18. Falconry permit.
19. Pronouncement of the Environmental Authority on the need or not to advance the process of modification of the environmental license – minor modifications or of normal adjustment within the ordinary course of the licensed activity.
20. Environmental licenses for the construction and operation of sanitary landfills that are assigned to the National Environmental Licensing Authority (ANLA) by virtue of orders issued by judicial and/or control authorities, the law and/or regulations.
