“Whereby Resolution No. 371 of June 6, 2024, is amended” THE PRESIDENT OF THE NATIONAL MINING AGENCY – ANM, whereby the ANM ordered:
ARTICLE 1. TO AMEND Article 5 of Resolution No. 371 of June 6, 2024, corrected by Resolution No. 441 of 2024, which shall read as follows:
rticle 5. Mandatory reporting of information through technological tools. For the technological component of information capture, the Web Form, it shall be mandatory for all mining license holders and beneficiaries of other entities that are legally authorized to explore and exploit non-renewable natural resources to report the information registration formats established in Article 6, according to the frequency established in Article 9 and the schedule related to Article 11 of this Resolution.
For titles classified as “Projects of National Interest,” in addition to the mandatory reporting of information registration formats in the web form, the technological component of Web Services will also be mandatory as a module for data and complementary information associated with mining production and must be implemented as of July 1, 2026.
Notwithstanding the foregoing, the mandatory nature of the technological component of Web Services as a module for data and complementary information for mining rights holders and beneficiaries of other entities that are legally authorized to explore and exploit non-renewable natural resources shall be conditional upon the results of the analysis conducted by the mining authority on the entity’s available information systems, in the information systems that are created and the variables subject to reporting in Article 6 and the schedule in Article 13 of this Resolution.
Paragraph One. The technological components for capturing information from the Web Form and Web Services will be available two months prior to the first reporting date stipulated in Article 11, allowing mining license holders and beneficiaries of other entities that are legally mandated to explore and exploit non-renewable natural resources to report in advance of the dates defined in Articles 11 and 13.
In order to use the alternative communication modules and complementary data and information, mining license holders and beneficiaries of other entities that are legally authorized to explore and exploit non-renewable natural resources must inform the mining authority prior to implementation in accordance with the conditions required and defined in the technical annex.
Paragraph Two. The implementation by mining license holders and beneficiaries of other entities that are legally authorized to explore and exploit non-renewable natural resources of the alternative communication module for reporting information registration forms does not modify the dates established in Article 11 and the reporting requirements defined in this article.
Paragraph Three. In the event of a reclassification of mining activities and if the reporting of information referred to in Articles 11 and 13 of this Resolution has already begun, the obligation to upload information shall be maintained under the terms stipulated in the previous classification. On the other hand, in the event of a reclassification of mining activities and if the reporting of information referred to in Articles 11 and 13 has not begun, the obligation shall be that corresponding to the new classification.
ARTICLE 2. MODIFY the third and sixth paragraphs of Article 11 of Resolution No. 371 of 2024, amended by Resolution No. 441 of 2024, which shall read as follows:
“(…) Paragraph Three. The “Technological Capacity” Information Registration Form, together with the “Control Point Flow Chart,” shall be mandatory, subject to penalties, and may be required for non-compliance with the following dates:
1. Titles for Projects of National Interest in the exploitation stage: October 2024
2. Large-scale mining titles in the exploitation stage: January 2025
3. Medium-scale mining titles in the exploitation stage: July 2026.
4. Small-scale mining titles in the exploitation stage: July 2027. (…)
Paragraph Six. The first reporting period for the information registration forms, in accordance with the dates described above, will be as follows: (image)
After this first information report, the obligation to report the information registration forms in the Web Form with expired frequency remains (with the exception of the FRI for Projections, which is reported in advance for the period being reported) in accordance with the provisions of Article 9 of this Resolution and according to the reporting frequency defined in the Information Registration form. For the Technological Capacity Information Registration Form and Control Point Flow Diagram, although they will remain mandatory and defined as annual, the following dates and information cut-off dates will apply for the second report:
1. National Interest Project Titles in the exploitation stage: January 2028 – information cutoff date December 31, 2027.
2. Large-Scale Mining Titles in the exploitation stage: January 2029 – information cutoff date December 31, 2028.
3. Medium mining titles in the exploitation stage: January 2030 – information cutoff date December 31, 2029.
4. Small mining titles in the exploitation stage: January 2031 – information cutoff date December 31, 2030.
ARTICLE 3. MODIFY Article 13 of Resolution No. 371 of June 6, 2024, amended by Resolution No. 441 of 2024, which shall read as follows:
ARTICLE 13. Schedule for reporting information on the web services component as a module for complementary data and information: Once the mechanisms for reporting complementary data and information have been implemented, the mining titleholder shall begin mandatory reporting of the information captured in accordance with the classification and dates indicated below:
1. Titles for Projects of National Interest in the exploitation stage: between January 1, 2025, and June 30, 2026.
2. Titles for large-scale mining in the exploitation stage: between January 1, 2027, and June 30, 2027.
3. Medium-scale mining titles in the exploitation stage: between January 1, 2028, and June 30, 2028.
4. Small-scale mining titles in the exploitation stage: between January 1, 2029, and June 30, 2029.
Paragraph One. Once the aforementioned deadlines have expired, the reporting of information in the complementary component will remain mandatory, and failure to comply will be subject to penalties in accordance with Article 14 of this Resolution.
ARTICLE 4. EFFECTIVE DATE. This resolution shall take effect on the date of its publication in the Official Gazette.
