Resolution 629 of 31 July 2020

‘Whereby article 5 of Resolution 1402 of 2018 is amended and other determinations are made.’

Article 1° of the Resolution states:
“Article 1. Object. To amend Article 5 of Resolution 1402 of 25 July 2018, which shall read as follows:

ARTICLE 5. Transitional regime. The environmental studies prepared in accordance with the methodology adopted by Resolution 1503 of 2010 and which were due to be submitted on 2 August 2020, will not be governed by this administrative act, provided that these studies are submitted within nine (9) months of the date on which the health emergency is lifted in the country, a period which cannot be extended.

Paragraph 1. Notwithstanding the above, the environmental studies referred to in this article, whose projects, works or activities must be subject to prior consultation and which could not be carried out within the term of the extension, may be filed after the date indicated above. such a situation must be reported to the competent environmental authority with the filing of the corresponding environmental study..

Paragraph 2. It is noted that as of 2 August 2020, environmental studies that are not in the transition indicated in this article and in its Paragraph 1, shall be prepared in accordance with the provisions of the General Methodology for the Preparation and Presentation of Environmental Studies adopted by Resolution 1402 of 2018..

Article 2. Validity and repeals. This resolution is effective from the date of its publication in the Official Journal and amends Article 5 of Resolution 1402 of 2018.
