Ecopetrol, ANH and Anla officials investigated over Lisama case

Juan Camilo Acosta, lawyer at Minería & Medio Ambiente Estudio Jurídico, explained what companies and officials would be exposed to if found guilty. ‘The first to be affected are the legal representatives of these companies, such as the directors, who are determined to have committed an act or omission. The legal sanctions in these cases are established by Law 1333 of 2009 and can be punished with measures such as the cancellation of the environmental licence and fines of 5,000 smmlv’.

Once removed from office, those responsible could face criminal prosecution. ‘As natural persons, the justice system would determine whether the sanctions previously imposed are sufficient or if they merit a new investigation,’ Acosta added.
